Today we’re covering a number of the standout brands in the robust and nebulous ‘Magic Mushroom Chocolate’ space. We must preempt with a caveat that there are only limited jurisdictions where these products may be legal according to the letter of the law, and that the protections afforded by the ‘Grow, Gather, Gift’ model of decriminalization or the religious protections claimed by any of a growing number of mushroom churches generally do not extend to buying and selling these products. For more on the complex interpretations of various regional laws pertaining to the magic mushroom consumer landscape, check out this article in Westword published on May 5th that details the case of a Denver magic mushroom co-op that has been fighting state regulators over where harm reduction and support services ends and commercialization begins.

The Consumer Packaged Goods market that is evolving around psilocybin mushrooms is outpacing the consumption of raw mushrooms themselves due to structural forces underpinning modern consumer behavior; people are accustomed to buying branded products in the food and beverage category rather than eating or drinking a raw ingredient.

Eating a handful of raw mushrooms can also deliver a wildly varying experience due to inconsistent dosing throughout the batch. This problem is much easier to solve in a standardized product. There’s also the tendency for raw mushroom fruit to cause discomfort or nausea in certain people; mixing with chocolate or other CPG formats can help to alleviate some of this discomfort. 

With the broader visibility of psilocybin in the media over recent years there has come a massive rise in demand that is currently unmet by a regulated supply, leaving an emerging category piecemealed together with unofficial yet increasingly substantive quality control and consumer protection frameworks. 

These early attempts at self-regulation remain fragmented, voluntary, and often difficult to verify yet have helped to create a sense of protective barriers and quality control through the rollout of services such as third party labeling integrity verification services like PsiloSafe and open data published from analytical testing labs such as Tryptomics.

For example, an increasing number of producers are including QR codes on their products that link to Certificates of Analysis (COA’s) — Here’s an example:

But even with this type of guard rail, there’s nothing stopping a producer from linking a falsified COA to the QR code on their product in such an unregulated space. This is where community vetting and due diligence falls upon the consumer.

New Psychoactive Substances, often called ‘Research Chemicals’ have also emerged as a byproduct of inefficient and outdated drug policy to color the magic mushroom chocolate category. These substances are manufactured in labs and bear similar effect profiles to psilocybin and psilocin, as a number of them convert into psilocin in the bloodstream after being metabolized by the body. This has created a booming category within ‘magic mushroom chocolates’ where internationally distributed brands like Tre House have carved out a massive share in the ‘smoke shop market’ or ‘gas station edible’ space while selling products allegedly falsely labeled as ‘magic mushroom chocolates’ with lack of ingredient disclosure represented as a ‘Proprietary mushroom blend’.

To quote an excellent article by journalist Bob Johnson in Rolling Stone that was published earlier this week and which covers this product category,

“If you want to blame someone for the gray market operators selling products you can’t compete with, blame the regulatory system that gave them the opening.”

Amanita muscaria chocolate

Amanita muscaria 🍄 is an entirely separate and distinct mushroom from the Psilocybe mushroom genus, yet the two are increasingly conflated by producers and consumers alike under the ‘magic mushroom’ label for marketing purposes.

Although the RAND Corporation ranked Amanita muscaria as the ‘third most used psychedelic’ in the United States in 2025, it’s widely considered to be much more of a dissociative and deliriant rather than a classic ‘psychedelic’. Here’s a great breakdown of the differences between Amanita muscaria and Psilocybin mushrooms from ACS Laboratories

Amanita muscaria and Psilocybes are both definitely ‘Magic Mushrooms’ but they differ drastically in profile and effects and bear little to no resemblance to each other in terms of the types of experiences they confer. A major categorical difference in regards to the product landscape is that Amanita muscaria mushrooms contain no scheduled substances — the active constituents of Muscimol, Ibotenic acid, and muscarine are all absent from the Controlled Substances Act, meaning that they are generally perceived to be ‘legal’ compounds in most states and countries around the world with few exceptions like Louisiana and Romania.
